3. The Service and your account
Scanluma runs automated accessibility checks on websites you submit and reports the issues it finds, with guidance on how to fix them.
The Service is intended for professional and business use. By using it you confirm that you are at least 18 years old and that you are acting on behalf of a business, organisation or your own professional practice, unless we have agreed otherwise in writing.
To create an Account, you must provide a valid email address and the name of the company, organisation or trade name on whose behalf you use the Service. You are responsible for keeping this information accurate and up to date. You are responsible for all activity under your Account, and for keeping your login details confidential. Tell us without delay at support@scanluma.com if you suspect unauthorised access.
Accounts are personal to you or your organisation. You may not share, resell or sublicense access to the Service unless your Plan explicitly allows it.
4. Plans and fair use
We offer a Free Plan and the paid Pro and Agency Plans. What each Plan includes, including any limits on the number of Target Websites, scans, team members or exports, is described on our pricing page. That description forms part of these terms.
The Free Plan is provided as it is, for as long as we choose to offer it. We may change or withdraw it at any time.
We may apply reasonable technical limits to protect the Service, such as limits on scan frequency, crawl depth, concurrent scans. If your use is far above what is normal for your Plan, or places an unreasonable load on our systems, we will contact you to agree a suitable Plan. If no agreement is reached, we may throttle or suspend your use under section 15.
5. Orders and payment
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles billing enquiries and refund requests, and provides the invoices for your purchase.
This means that when you buy a Subscription, you enter into a purchase agreement with Paddle, while these terms govern your use of the Service itself. Paddle’s own buyer terms apply to the payment transaction.
Payment is due in advance for each billing period, monthly or annually depending on the Plan you choose. Your chosen payment method is charged automatically at the start of each period.
If a payment fails, Paddle will retry it and may contact you. If payment is still not received, we may suspend access to paid features until the outstanding amount is paid, and we may terminate the Subscription.
6. Prices and taxes
All prices shown on our pricing page are exclusive of VAT and any other sales tax. The applicable tax is calculated and added at checkout, based on your location and the tax details you provide.
If you are a business in the European Union outside the Netherlands and you supply a valid VAT identification number, the reverse charge mechanism applies and no VAT is added. You remain responsible for the accuracy of the VAT number you provide.
Paddle collects and remits VAT and sales taxes as Merchant of Record, and issues the invoice for your purchase.
We may change our prices. For existing Subscriptions, we will give you at least 30 days’ notice by email before a price change takes effect. The new price applies from your next renewal. If you do not accept it, you may cancel before the renewal date in line with section 7.
7. Term, renewal and cancellation
A Subscription starts when your first payment is completed and runs for the billing period you chose. It renews automatically for the same period unless you cancel.
You can cancel at any time through the customer portal linked from your account, or by emailing support@scanluma.com. Cancellation takes effect at the end of the current billing period.
After cancellation you keep access to your paid features until the end of the period you have already paid for. We do not refund the remainder of a period that has started, except where section 8 or mandatory law says otherwise.
When a Subscription ends, your Account reverts to the Free Plan and the limits of that Plan apply immediately. Features and Reports that are not included in the Free Plan may no longer be available to you.
We do not delete your Reports or scan history when a Subscription ends. They become accessible again if you subscribe to a paid Plan later.
Closing your Account is different: when you close it, we delete your Account data, Reports and scan history immediately, and this cannot be undone. Residual copies may remain in our backups until those are overwritten in the normal rotation. Export anything you want to keep before you close your Account.
8. Refunds and right of withdrawal
We offer a refund of your first payment if you request it within 14 days of that payment. Send refund requests to support@scanluma.com or to Paddle, who processes them on our behalf. Renewal payments are not refundable, except where mandatory law requires it.
If you are a consumer in the European Union, you normally have a statutory right to withdraw from a distance contract within 14 days. Because the Service is digital content and access is granted immediately, you expressly request immediate performance at checkout and acknowledge that you lose your right of withdrawal once the Service has been made available to you.
This section does not affect your statutory rights where the Service is faulty or not as described.
9. Your obligations and acceptable use
You may only submit a Target Website that you own, operate, or are authorised by its owner to test. By submitting a Target Website you confirm that you have that authorisation, and that scanning it does not breach any agreement or policy that applies to it.
Scans generate automated requests to the Target Website. You are responsible for any effect this has on that site, including bandwidth use, rate limits and log entries.
You must not:
- use the Service to scan, probe or test a website you are not authorised to test;
- attempt to disrupt, overload or gain unauthorised access to the Service or the systems it runs on;
- circumvent limits on your Plan, including by creating multiple Accounts;
- resell, white-label or make the Service available to third parties, unless your Plan allows it;
- copy, decompile or reverse engineer the Service, or use it to build a competing product;
- use the Service to break the law or infringe anyone’s rights.
You indemnify us against third-party claims arising from your breach of this section.
10. No guarantee of legal compliance
Scanluma uses automated testing. Automated tools can only detect part of the accessibility issues on a website. Many success criteria of the Web Content Accessibility Guidelines require human judgement and manual testing, which the Service does not provide.
A passing Scan or Report therefore does not mean that a website conforms to WCAG, the European Accessibility Act, the Web Accessibility Directive, the Americans with Disabilities Act or any other standard or law. Equally, a reported issue is not in itself proof of a legal violation.
Reports are information, not legal advice and not an accessibility audit or certification. You remain responsible for assessing your own compliance obligations and, where needed, for obtaining a manual audit and professional or legal advice.
We do not accept liability for claims, fines or proceedings relating to the accessibility or compliance of your website.
11. Availability and support
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. We give no service level commitment unless we have agreed one with you in writing.
We may carry out maintenance that temporarily limits availability. Where planned maintenance is likely to cause noticeable downtime, we will try to announce it in advance and to schedule it outside European business hours.
Support for paid Plans is provided by email at support@scanluma.com, normally within two business days. The Free Plan is provided without a support commitment.
We may change, improve or discontinue features. If we discontinue a feature that is material to your Plan, we will notify you at least 30 days in advance and, at your request, refund the unused part of your current billing period.
12. Intellectual property
The Service, including its software, design, documentation, name and logo, belongs to us or our licensors. These terms give you a limited, non-exclusive, non-transferable right to use the Service during your Subscription, and nothing more.
Content you submit, such as the URLs of your Target Websites and anything you upload, remains yours. You grant us the right to process it as far as needed to provide the Service.
Reports generated for you are yours to use, share with your clients and include in your own deliverables. The underlying rule set, scoring logic and software stay ours. You may not extract or republish Report data as a dataset or product of your own.
If you send us suggestions or feedback, we may use them freely and without payment or obligation to you.
13. Privacy and data processing
How we handle personal data is described in our Privacy Policy, which forms part of these terms.
We use a limited number of sub-processors to run the Service, including our hosting provider, our email provider and Paddle for payments. The current list is in the Privacy Policy.
Scanluma is designed to scan public web pages and does not need personal data from your Target Website. If your use of the Service does involve us processing personal data on your behalf, our Data Processing Agreement applies. You can request it at support@scanluma.com.
You are responsible for ensuring that you may lawfully submit a Target Website for scanning, including any page behind a login that you give us access to.
14. Warranties and liability
The Service is provided as it is. To the extent permitted by law, we give no warranty that it will be error-free, that every accessibility issue will be detected, or that it will meet a particular purpose of yours.
We are not liable for indirect or consequential loss, including lost profit, lost revenue, lost business, loss of goodwill or loss of data, or for claims brought against you by third parties about the accessibility of your website.
Our total liability in any 12-month period is limited to the amount you paid for the Service in that period, or EUR 500 if that amount is higher.
These limits do not apply to liability for intent or deliberate recklessness on our part, to death or personal injury, or to any other liability that cannot be excluded under Dutch law. If you are a consumer, your mandatory statutory rights are unaffected.
A claim must be brought within 12 months of the event giving rise to it.
15. Suspension, termination and changes to these terms
We may suspend or terminate your Account if you materially breach these terms, if payment remains outstanding, or if your use threatens the security or stability of the Service. Where circumstances allow, we will warn you first and give you an opportunity to put things right.
We may also terminate a Subscription for convenience by giving you 30 days’ notice. In that case we refund the unused part of the period you have paid for.
On termination, your right to use the Service ends. We may delete your data after 30 days, unless we are required to keep it for longer.
We may amend these terms, for example when the Service changes or the law changes. For material changes affecting an active Subscription, we will notify you by email at least 30 days in advance. If you do not accept the change, you may cancel before it takes effect. Continued use after that date means you accept the new terms.
16. Governing law and disputes
These terms are governed by Dutch law. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Disputes are submitted to the competent court in [Leeuwarden], the Netherlands, unless mandatory law gives you the right to bring the matter before another court. Consumers in the EU may also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.
If a provision of these terms is invalid or unenforceable, the rest remains in force, and the invalid provision is replaced by a valid one that comes closest to its intended effect.
We may transfer our rights and obligations under these terms to another party, for example if the business is sold. You may not transfer yours without our written consent.
Questions about these terms can be sent to support@scanluma.com.
